Terms of sale

Preamble
These terms and conditions of sale (hereinafter "Terms") govern the contractual relationship between Aura Créative and any non-professional natural person (hereinafter "the Customer") making a purchase on the website auracreative.com. They are accessible at any time on the website and prevail over any other document. By proceeding to the payment step, the Customer accepts these Terms in full. The contract is governed by French law (see Article 16).
Article 1. Identification of the seller

Article 2. Purpose and scope
These Terms govern the distance sale of original, one-of-a-kind artworks offered by Aura Créative on its website. They apply to any order placed by a Customer residing in metropolitan France, acting for purposes outside their commercial, industrial, craft or professional activity, and legally able to enter into a contract.
Article 3. Essential characteristics of the artworks
Each artwork offered for sale is a one-of-a-kind, hand-painted piece, identifiable by its title, dimensions, technique, year of creation and photographs, in compliance with art. L221-5 of the French Consumer Code. Slight rendering variations may exist between the on-screen image and the physical artwork (screen calibration, ambient light). These do not constitute a defect of conformity.
Article 4. Prices
Prices are shown in euros, inclusive of all taxes (with the notice "VAT not applicable, French CGI art. 293 B"). The prices displayed at the date of the order are the only ones applicable. Aura Créative reserves the right to change its prices at any time; artworks are invoiced at the price in force at the time the order is validated.
Shipping fees are charged in addition to the artwork price, as detailed in Article 7.
Article 5. Order
The Customer places an order by selecting the desired artwork, then accessing the payment link provided by Aura Créative. Payment is made via the EasyTransac payment platform (see Article 6). Upon receipt of payment, Aura Créative sends the Customer a confirmation email summarising the order. The sale is firm and final upon effective receipt of payment.
Aura Créative reserves the right to refuse or cancel any order in case of prior dispute with the Customer, suspicion of fraud, or unavailability of the artwork. The Customer is informed without delay and fully refunded if payment has already been collected.
Article 6. Payment methods and security
Accepted payment methods: credit/debit card (Visa, Mastercard, Carte Bleue).
Payment provider: transactions are processed by EasyTransac, a brand of Provence Telecom SAS, a payment institution authorised by the French Prudential Supervision and Resolution Authority (ACPR) under number 16958. EasyTransac relies on Checkout.com, an authorised payment institution, as the acquirer for card transactions.
Security: strong cardholder authentication (3D Secure v2, in compliance with the PSD2 directive) is systematically applied. Checkout.com is certified PCI-DSS Level 1, the highest level of the Payment Card Industry Data Security Standard. No card data is stored by Aura Créative; card details are transmitted exclusively through the secure infrastructures of the payment providers.
Validation: the order is firm after bank authorisation and confirmation of payment by EasyTransac. In case of bank refusal, the order is automatically cancelled and no amount is debited.
Article 7. Shipping
Shipping zone: metropolitan France only. Any request for delivery outside this zone requires a specific quote, to be requested by email before ordering.
Shipping methods:
- Colissimo tracked and insured, flat fee 25 €. Indicative delivery time: 2 to 5 business days after dispatch.
- Hand-delivery by appointment (Plobsheim or Strasbourg), 0 €.
Dispatch time: artworks are dispatched within 7 business days of receipt of payment.
Risk transfer: pursuant to art. L216-4 of the French Consumer Code, the risk of loss or damage of the artwork is transferred to the Customer upon effective delivery (signature by the Customer or by the third party they designated).
Delivery delay: if the indicated delivery time is exceeded by more than 30 days, and after a formal notice has remained unsuccessful, the Customer may terminate the contract pursuant to art. L216-2 of the French Consumer Code and obtain a full refund.
Receipt and reservations: upon delivery, the Customer must check the condition of the parcel and the artwork. In case of visible damage, precise and detailed handwritten reservations must be noted on the carrier's slip, and Aura Créative must be informed by email within 48 hours.
Article 8. Right of withdrawal
Pursuant to art. L221-18 of the French Consumer Code, the Customer has a period of fourteen (14) calendar days from receipt of the artwork to exercise the right of withdrawal, without justification or penalty.
How to exercise: the Customer notifies their decision to withdraw by an explicit and unambiguous declaration sent by email to contact@aura-creative.com, or by using the model withdrawal form set out in Article 9 below.
Effects: in case of valid withdrawal, Aura Créative refunds the Customer all sums paid (artwork and standard outbound shipping costs), no later than fourteen (14) days after being informed of the withdrawal. The refund may be deferred until the artwork is recovered or until the Customer provides proof of dispatch (art. L221-24 of the French Consumer Code).
Return costs: the direct cost of returning the artwork is borne by the Customer (art. L221-23 of the French Consumer Code).
Condition of the artwork: the artwork must be returned in its original packaging, in perfect condition. The Customer's liability is engaged for any depreciation of the artwork resulting from handling other than that necessary to establish its nature, characteristics and proper functioning.
Note: although art. L221-28, 3° of the French Consumer Code provides for an exception to the right of withdrawal for goods made to the consumer's specifications, Aura Créative chooses to maintain the right of withdrawal for all its artworks, including pre-existing one-of-a-kind pieces, as a consumer-friendly approach.

Article 10. Legal warranties
The Customer benefits from the legal warranty of conformity provided for by articles L217-3 et seq. of the French Consumer Code, as well as from the warranty against hidden defects under articles 1641 et seq. of the French Civil Code.
Under the legal warranty of conformity, the Customer has a period of two years from delivery of the artwork to act against Aura Créative (art. L217-7 of the French Consumer Code). They may choose between repair or replacement of the artwork, subject to the cost conditions set out in art. L217-12 of the French Consumer Code. The Customer is exempted from proving the existence of the lack of conformity during the 24 months following delivery.
The legal warranty of conformity applies independently of any commercial warranty granted. The Customer may decide to invoke the warranty against hidden defects within the meaning of article 1641 of the French Civil Code; in such case, they may choose between rescission of the sale or a price reduction in accordance with article 1644 of the French Civil Code. Action for hidden defects must be brought within two years of discovery of the defect (art. 1648 § 1 of the French Civil Code), and within twenty years of contract formation at the latest (art. 2232 of the French Civil Code).
How to invoke: the Customer sends their claim, with photographs and a description of the defect, to contact@aura-creative.com.
Article 11. After-sales service, complaints and mediation
Complaints service: contact@aura-creative.com. Aura Créative undertakes to provide a reasoned response within fourteen (14) business days.
Consumer mediation: pursuant to art. L612-1 of the French Consumer Code, the Customer has the right to free recourse to a consumer mediator for the amicable resolution of any dispute with Aura Créative that could not be resolved directly.

Article 12. Limitation of liability
Aura Créative undertakes to perform its obligations diligently and in good faith. Its liability shall not be engaged in case of non-performance due to force majeure as defined by art. 1218 of the French Civil Code and French case law (natural disaster, armed conflict, carrier strike, widespread network outage, decision of a public authority, etc.).
Save in cases of gross negligence or wilful misconduct, Aura Créative shall not be held liable for indirect damages suffered by the Customer in connection with the sale (loss of enjoyment, loss of opportunity, reputational harm). The total compensation owed by Aura Créative is in any event capped at the amount of the relevant order.
Article 13. Intellectual property of the artworks
Purchase of an artwork by the Customer transfers the material ownership of that artwork upon full payment and effective delivery. Pursuant to art. L111-3 of the French Intellectual Property Code, this transfer does not entail an assignment of copyright (right of reproduction, right of representation, right of adaptation), which remain entirely with Aura Créative. The Customer is allowed to display the artwork in a private setting. Any commercial exploitation, reproduction, publication or public display of the artwork requires Aura Créative's prior written consent.
Article 14. Personal data
Processing of personal data collected as part of the order is governed by the privacy policy, which the Customer is invited to read.
Article 15. Modification of the Terms
Aura Créative reserves the right to modify these Terms at any time. The Terms applicable to an order are those in force at the date of validation of the order by the Customer. In case of substantial modification, Customers who provided their email address may be informed electronically.
Article 16. Governing law and jurisdiction
These Terms are governed by French law. In case of dispute, the parties shall favour an amicable resolution, where applicable through the consumer mediator designated in Article 11.
Failing amicable resolution, any dispute relating to the interpretation or performance of these Terms falls within the jurisdiction of French courts. Pursuant to art. R631-3 of the French Consumer Code, the consumer Customer may, at their option, bring the matter before one of the courts having territorial jurisdiction under the French Code of Civil Procedure, or the court of the place where they were domiciled at the time the contract was concluded or at the time the harmful event occurred.
Article 17. Acceptance
The Customer's click on the payment button granting access to the EasyTransac platform constitutes full and unreserved acceptance of these Terms.
